Service Description
Alabama Pest Control provides professional pest management services throughout the State of Alabama, including but not limited to residential and commercial pest control, termite inspection and treatment, rodent exclusion, mosquito control, bed bug elimination, and wildlife removal. Our technicians employ integrated pest management techniques, licensed pesticides, trapping systems, and preventive measures tailored to the specific pest pressures common to Alabama's climate and geography. Services may be provided as one-time treatments, recurring maintenance plans, or emergency response visits depending on the nature of the infestation and the service agreement selected. All treatments are performed by licensed applicators in accordance with regulations established by the Alabama Department of Agriculture and Industries and the Environmental Protection Agency. Service scope, frequency, and pricing are determined by written agreement or work order signed prior to commencement of services. We reserve the right to modify treatment protocols based on site conditions, weather events, pest biology, regulatory changes, or other factors that may affect efficacy.
No Guarantee or Warranty
Alabama Pest Control makes no express or implied guarantees regarding the complete or permanent elimination of pests from any treated property. Pest management outcomes depend on numerous variables beyond our reasonable control, including but not limited to structural conditions of the building, sanitation practices, adjacent land use, climate variation, pest species resistance, and customer compliance with recommended preparations and follow-up measures. While we strive to achieve optimal results using industry-standard methods, pest behavior and environmental factors cannot be predicted with certainty. Any warranty or guarantee offered in a separate signed service agreement shall control over this general provision and shall be limited to the specific terms, duration, and conditions stated therein. General pest control services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability or fitness for a particular purpose.
User Responsibilities
Customers are responsible for providing accurate information about the property, existing pest conditions, prior treatments, and any health concerns or chemical sensitivities of occupants or pets. You must ensure safe access to all areas requiring treatment, secure pets and personal belongings as directed, and comply with all pre-treatment and post-treatment instructions provided by our technicians. Failure to follow these instructions may reduce treatment effectiveness and void any applicable service warranty. Customers must disclose the presence of wells, cisterns, fish ponds, vegetable gardens, or other sensitive areas before treatment. You are responsible for maintaining proper sanitation, sealing structural entry points when recommended, and notifying us promptly if pest activity persists or worsens. Payment is due according to the terms specified in your service agreement. Delinquent accounts may result in service suspension and additional collection efforts.
Limitation of Liability
To the maximum extent permitted by Alabama law, Alabama Pest Control shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including lost profits, property damage beyond the scope of direct treatment areas, personal injury except where caused by our gross negligence or willful misconduct, or damages resulting from pest-related property destruction, contamination, or health issues. Our total cumulative liability for any claim shall not exceed the amount paid by the customer for the specific service giving rise to the claim during the twelve months preceding the event. These limitations apply regardless of the legal theory asserted, whether contract, tort, strict liability, or otherwise, and even if advised of the possibility of such damages. Customers agree that this limitation represents a reasonable allocation of risk reflecting the pricing of our services.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and proprietary information displayed on Alabama Pest Control websites, marketing materials, service reports, and documentation are the exclusive property of Alabama Pest Control or its licensors. Customers receive no ownership interest in any intellectual property through the purchase of pest control services. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any materials without prior written consent. Technical information, treatment methodologies, and operational procedures developed or employed by Alabama Pest Control constitute trade secrets and confidential business information protected under applicable law. Unauthorized disclosure or use of such information is strictly prohibited and may result in legal action.
Governing Law
These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution shall be instituted exclusively in the state or federal courts located in Alabama, and customers irrevocably submit to the jurisdiction of such courts. The parties waive any objection to venue in such courts. If any provision of these terms is held invalid or unenforceable under Alabama law, the remaining provisions shall continue in full force and effect. These terms constitute the entire agreement between the parties regarding the subject matter herein and supersede all prior or contemporaneous agreements, whether oral or written.
Changes to Terms
Alabama Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective immediately upon posting to our website or, for active service customers, upon reasonable notice provided through the contact information on file. Continued use of our services following any modification constitutes acceptance of the revised terms. Customers are encouraged to review these terms periodically. Material changes affecting pricing, liability limitations, or dispute resolution procedures will be communicated with at least thirty days advance notice where practicable. The effective date displayed at the top of this document indicates the most recent revision.
